The Process
A Message From Barry


Allow me to introduce myself.
I am Barry Wiles, a professional with a background in the law and have an Ll.B. Honours degree from London University (London School of Economics).
I have drafted wills and administered deceased’s estates since the early 1970s and during that period have made many applications to the Court of Protection on behalf of relatives of mentally incapable patients.
I have been drafting Lasting Powers of Attorney since they were first introduced in 2007, having previously drafted numerous Enduring Powers of Attorney (which were used for similar purposes before that).
I am concerned that too often the personal relationship between professional and client has been eroded. Instead it has been replaced with a “one size fits all” approach which does not cater for individual requirements.
My services have been designed to provide a friendly one-to-one approach characterised by the now long dead concept of the “family solicitor”. If you use me, it is me you will get!
To keep things as clear and simple as possible, I have refined the process to six easy steps, shown below.
Step 1 - Zoom Video Meeting
First, we have a video meeting by Zoom, Facetime or WhatsApp. (We can also have the meeting over the phone if you would prefer.) Here we discuss what you want to do and the choices which you will be asked to make on the documents.
Step 2 - Choose Your Attorneys and Certificate Provider
You go away and choose who you would like to choose as attorneys. In addition, you need to choose a certificate provider, who should be a friend who has known you for some time and is not a relative.
Step 3 - Provide Me With Details
You supply me with the required information by completing a form online. That includes names and addresses of yourselves, your proposed attorneys and your certifier.
Step 4 - Pay The Fee
You pay my fee, along with the fee for registration if you wish me to register the LPA(s) on your behalf. I will then draw up and send you your LPA(s) for you to approve and sign.
Step 5 - Meet for Signing
You, your attorneys and your certificate provider all arrange to meet to sign the LPA(s), and I will join you at that meeting via another video call to help guide you through the signing process.
Step 6 - Send Me the LPAs
You send the completed LPA(s) to me. I check them over, making sure all signatures are in the correct place. I will then send it directly to the Office of the Public Guardian for registration, if you have asked me to do so. Otherwise I will return the documents to you so that you can send them in the future.
